Terms of Service
Effective August 9, 2026
These Terms are an agreement between you and Joshua Brooks doing business as Vehicle Proof (“Vehicle Proof,” “we,” or “us”). By creating an account, starting a paid subscription, or using the service, you agree to these Terms.
1. Business service and eligibility
Vehicle Proof is vehicle inspection documentation software for businesses and automotive professionals. You must be at least 18 and able to enter a binding agreement. If you use Vehicle Proof for a company or other organization, you represent that you have authority to bind it to these Terms.
2. Accounts and business workspaces
You must provide accurate account information, protect login credentials, and promptly notify us of suspected unauthorized access. The business owner controls workspace settings, billing, and technician access. You are responsible for activity performed through your workspace and for ensuring that each user follows these Terms.
Technician removal disables future workspace access but does not erase historical attribution, inspections, reports, or other records associated with completed work.
3. The service
Vehicle Proof helps users collect notes, photographs, narration, signatures, findings, and vehicle information; organize inspection records; and produce customer-facing reports. Vehicle Proof is not shop-management, accounting, legal-compliance, appraisal, engineering, or diagnostic software.
We may improve or change the service over time. We will not intentionally make a material paid feature unavailable without reasonable notice unless necessary for security, law, provider availability, or prevention of harm.
4. Technician judgment and AI drafts
Vehicle Proof may transcribe narration and use AI to organize stated observations into draft findings. AI output can be incomplete or incorrect and does not determine vehicle condition, diagnose a problem, infer unseen damage, or replace a qualified technician. A technician must review, correct, approve, or delete every AI-created finding before completing an inspection.
You remain solely responsible for inspections, classifications, recommendations, customer communications, and professional decisions made using the service.
5. Your content and customer permissions
You retain ownership of content you submit. You grant Vehicle Proof a limited, worldwide license to host, process, reproduce, format, transmit, and display that content only as needed to operate, secure, support, and improve the service and fulfill your instructions.
You represent that you have the rights and permissions needed to submit the content and allow this processing. You are responsible for notices and consents required for customer information, vehicle information, photographs, audio recording, employee activity, signatures, and public report sharing. Do not submit unlawful content or highly sensitive information that the service is not designed to handle.
6. Public reports
Report links are designed to be difficult to guess but can be opened without a customer login. Anyone with a report link may be able to view its contents. You control report publication and sharing and are responsible for sending links only to intended recipients. A report documents information entered and approved by the business; it is not a guarantee of vehicle condition or a representation that every condition was visible or inspected.
7. Plans, limits, and trials
Current plan features, prices, billing intervals, and taxes are disclosed at checkout. The Starter plan is limited to one user and 15 inspections started during each monthly allowance period, including when Starter is purchased annually. The Solo plan is limited to one user and includes unlimited inspections subject to reasonable use. The Shop plan includes one owner and up to four technician users and includes unlimited inspections subject to reasonable use. Unused Starter inspections do not roll over.
Vehicle Proof may offer a 14-day trial without requiring payment information. A trial does not automatically become a paid subscription unless you affirmatively choose a paid plan and provide a payment method through Stripe Checkout. We may limit repeated trials or promotional offers.
8. Billing, renewal, and cancellation
Paid subscriptions renew automatically for the monthly or annual billing interval selected at checkout until canceled. By subscribing, you authorize Stripe to charge the stated subscription price and applicable taxes at each renewal. Prices may change for a future renewal after reasonable advance notice.
You may cancel through the Stripe-hosted billing portal available from Vehicle Proof. Cancellation takes effect at the end of the current paid billing period, and access continues through that date unless the account is suspended for a separate violation. Except where required by law or expressly stated otherwise, payments are non-refundable and partial billing periods are not prorated.
If payment fails, Stripe may retry the payment and send recovery notices. Vehicle Proof may allow a limited grace period. After that period, we may block new inspections and team invitations while preserving read access to existing records. Successful payment may restore access.
9. Acceptable use
You may not use Vehicle Proof to:
- Break the law, violate another person’s rights, or collect information without required permission.
- Upload malware, harmful code, or content intended to disrupt or compromise the service.
- Probe, bypass, or interfere with authentication, access controls, usage limits, or business-data boundaries.
- Use automated means to overload, scrape, resell, or duplicate the service except through an interface we expressly provide.
- Misrepresent AI output as an independent diagnosis or conceal that required technician review did not occur.
- Use Vehicle Proof for surveillance, discrimination, fraud, or other harmful conduct.
10. Vehicle Proof ownership
Vehicle Proof and its software, design, branding, documentation, and other service materials are owned by Vehicle Proof or its licensors and protected by applicable law. These Terms grant only a limited, revocable, non-transferable right to use the service during an authorized account or subscription. Feedback may be used without restriction or compensation.
11. Third-party services
The service depends on third parties such as Stripe, Supabase, Cloudflare, OpenAI, and PostHog. Their availability and processing can affect Vehicle Proof. Your use of third-party features may also be subject to their terms. We are not responsible for third-party services outside our reasonable control.
12. Suspension and termination
You may stop using Vehicle Proof at any time and may cancel a paid subscription as described above. We may suspend or terminate access for material breach, unlawful or harmful conduct, nonpayment, security risk, or when required by law. When practical, we will provide notice and an opportunity to correct the issue.
Following termination, we may retain or make records available for a reasonable period, subject to legal, security, backup, and record-integrity requirements. You should export reports you need for your own records.
13. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VEHICLE PROOF IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE, AI OUTPUT, TRANSCRIPTS, REPORTS, OR THIRD-PARTY SERVICES WILL BE ERROR-FREE, COMPLETE, UNINTERRUPTED, OR SUITABLE FOR A PARTICULAR INSPECTION, TRANSACTION, OR LEGAL REQUIREMENT.
Nothing in these Terms excludes a warranty or right that cannot legally be excluded.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VEHICLE PROOF WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, BUSINESS, DATA, OR GOODWILL; VEHICLE DAMAGE; MISSED CONDITIONS; CUSTOMER CLAIMS; OR THE COST OF SUBSTITUTE SERVICES.
VEHICLE PROOF’S TOTAL LIABILITY ARISING OUT OF THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID VEHICLE PROOF DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $100 IF YOU USED ONLY A FREE TRIAL. These limits do not apply where prohibited by law.
15. Indemnification
To the extent permitted by law, you will defend and indemnify Vehicle Proof from third-party claims, damages, and reasonable costs arising from your content, inspections, reports, customer relationships, violation of law, or breach of these Terms. This obligation does not apply to the extent a claim was caused by Vehicle Proof’s own unlawful conduct.
16. Governing law and disputes
These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles. Before filing a claim, you and Vehicle Proof agree to make a good-faith effort to resolve the dispute by written notice and at least 30 days of informal discussion. Any court proceeding must be brought in a state or federal court with jurisdiction in Alabama, unless applicable law requires otherwise.
17. Changes
We may update these Terms as the service or law changes. We will post the revised Terms and update the effective date. Material changes will apply prospectively after reasonable notice. Continued use after the effective date of updated Terms constitutes acceptance where permitted by law.
18. General terms
These Terms and the Privacy Policy are the agreement between you and Vehicle Proof concerning the service. If one provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, sale, or transfer of the service.
